Voyageurs du Monde, a public limited company registered with the Paris Trade and Companies Register under number 315 459 016, whose head office is located at 55 rue Sainte-Anne, 75002 Paris (hereinafter “Voyageurs du Monde”, “we”, “us”, “our”), takes the protection of personal data very seriously. Voyageurs du Monde ensures strict compliance with the provisions relating to the protection of personal data, and in particular those of the French Data Protection Act (Loi Informatique et Libertés) of 6 January 1978 as amended, Regulation (EU) 2016/679 (the “GDPR”), and the recommendations issued by the French Data Protection Authority (CNIL), hereinafter referred to as the “Applicable Legislation”.

1. ABOUT THIS PRIVACY POLICY

As the data controller responsible for processing your personal data, Voyageurs du Monde uses this privacy and cookie policy (“Privacy Policy”) to explain how we may collect, use and process personal data (“Personal Data”) provided when users access our website(s) (the “Site”) or use our services (the “Services”), whether as clients or prospective clients.

2. HOW IS PERSONAL DATA COLLECTED?

We may collect your personal data directly from you:

when you create a Client Account on the Site or when you book a trip with Voyageurs du Monde;
when you communicate with our customer services by email, during telephone conversations with us, or during in-person appointments with our travel specialists at the agency.

We may also obtain information about you from other sources. For example, we may use third-party providers to supply us with additional information about existing clients, including information from your profile or posts on a third-party social network.

We may also collect information appearing on your profile on a third-party social media site (such as Facebook) if you authorise the third-party social network to share it with us, or if you make it publicly available. This information may include general account information (for example, name, email address, profile picture, gender, date of birth, current city, username, friend list, etc.), as well as any other information or activity that you authorise the third-party social network to share with us or that you publicly post on your profile. For example, we may receive your social media information (or part of it) when you download or interact with one of our apps on a social networking site (in particular Facebook). 3. WHAT PERSONAL DATA DO WE COLLECT?

Personal data refers to any information relating to an individual from which that individual can be identified, directly or indirectly.

The personal data we collect from users of the Site or from clients or prospective clients using our Services includes:

your surname(s) and first name(s),
your date of birth,
your gender,
your postal address,
your email address,
your phone number(s),
a copy of your ID only if you entrust us with the booking of your flights,
your booking history,
where applicable, special category data such as health information (disability, allergy or specific conditions) or data that could indirectly reveal information about the religious beliefs or personal convictions of the individuals concerned (dietary requirements, for example),
and any other information you may provide when using the Site or our Services.

We may also collect personal data relating to third parties. When you use our Services, you have the option to provide the contact details of one or more other individuals (other travellers, an emergency contact, or persons who have contributed to a gift list), or in connection with other events (for example, a wedding or birthday). In doing so, you guarantee to Voyageurs du Monde that the individuals whose data you provide have been informed of such transmission and have accepted it.

4. WHY DO WE COLLECT PERSONAL DATA?

The processing operations carried out and the legal bases on which we collect your personal data are as follows:

5. WHO ARE THE RECIPIENTS OF YOUR PERSONAL DATA?

Your personal data is intended for the relevant Voyageurs du Monde departments involved in handling your requests. We ensure that only duly authorised individuals have access to your personal data, where such access is necessary for the purposes described above.

Voyageurs du Monde is committed to not transferring or selling your personal data to non-partner third parties.

We may share your personal data with the following third parties, in accordance with the Applicable Legislation:

our affiliated entities, in order to provide you with the requested Services;
our business partners, in particular providers of the booked travel services (hotels, carriers, activity providers, excursion operators, etc.) or technical service providers (IT, hosting, email distribution, online payment providers, etc.). We take particular care to ensure that these third parties provide sufficient guarantees to protect and secure your personal data;
to duly authorised French or foreign authorities, for example, the tax authorities or the French Data Protection Authority (CNIL - Commission Nationale de l'Informatique et des Libertés), especially in the context of legal proceedings or a request for disclosure of data.

6. PERSONAL DATA SECURITY

As the data controller responsible for processing your personal data, Voyageurs du Monde implements all appropriate technical and organisational measures to ensure the protection of your personal data, and strives to limit the amount of data processed with regard to the intended purposes. We have established procedures to address any suspected personal data breach and will notify you and any competent supervisory authority of a suspected breach when we are legally required to do so.

However, the security of data transmissions over the internet or data storage systems cannot be 100% guaranteed. If you have any reason to believe that your interaction with us is no longer secure (for example, if you think the security of an account you hold with us has been compromised), please inform us immediately by contacting us using the details provided above.

7. PROCESSING OF DATA OUTSIDE THE EUROPEAN UNION

We may transfer your personal data to countries located outside the European Economic Area (“EEA”) solely for the purposes described in this Privacy Policy.

Where personal data is transferred outside the EEA, we will take appropriate measures to ensure that the recipient provides an adequate level of protection for your personal data, in accordance with this Privacy Policy. Such measures may include:

(a) obtaining your consent;

(b) ensuring that an adequacy decision has been adopted by the European Commission in the event of a transfer outside the EEA, meaning that the recipient country is deemed to provide an adequate level of protection for personal data;

(c) entering into an intra-group data transfer agreement in accordance with the European Union’s standard contractual clauses; or

(d) entering into the standard contractual clauses published by the European Commission. These standard contractual clauses include specific safeguards designed to protect personal data.

8. HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

We retain your personal data only for as long as is necessary to fulfil the purposes for which it was collected, including for the purpose of complying with any legal or accounting requirements.

To determine the appropriate retention period for personal data, we take into account the amount, nature and sensitivity of the personal data, the potential risk of harm resulting from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether those purposes can be achieved by other means, as well as applicable legal requirements.

We retain the following information for the periods set out below:

Prospective clients subscribed to the newsletter: Maximum retention period: Three years from the date of the last contact between the prospect and Voyageurs du Monde
Prospective clients who have requested a quote that did not result in a booking: Maximum retention period: Ten years from the date of the last contact between the prospect and Voyageurs du Monde
Clients: Maximum retention period:
- - 15 years from the date of last contact between the client and Voyageurs du Monde
- - 1 month after returning from the trip for copies of identity documents
- - 10 years for travel contracts, registration forms and invoices (legal requirement)
- - 10 years after returning from the trip in the event of bodily injury related to the trip (legal obligation)
- - In the event of legal proceedings, until the proceedings have been fully concluded.

Once the above retention periods have expired, the data is either deleted or retained in anonymised form, in particular for statistical purposes. Data may be retained in the event of pre-litigation or litigation. Please note that deletion or anonymisation is irreversible, and Voyageurs du Monde will no longer be able to restore such data thereafter.

9. RIGHTS OF DATA SUBJECTS

As a data subject, you have various rights. These rights are not absolute, and each of them is subject to certain conditions in accordance with the GDPR and applicable national laws.

right of access – you have the right to obtain confirmation from us as to whether or not your personal data is being processed, as well as certain other information (similar to that provided in this Privacy Policy) on how it is used. You also have the right to access your personal data by requesting a copy of the personal data relating to you. This enables you to verify that we are using your information in accordance with data protection laws. We may refuse to provide information where doing so would disclose personal data relating to another individual or adversely affect the rights of another person.
right to rectification – you may ask us to take steps to correct your personal data if it is inaccurate or incomplete (for example, if we hold an incorrect name or address).
right to erasure – also known as the “right to be forgotten” – this right allows you, in simple terms, to request the erasure or deletion of your personal data where, for example, there is no compelling reason for us to continue using it or where its use is unlawful. This is not, however, a general right to erasure, and certain exceptions apply, for example where we are required to retain or use the information to defend legal action or to comply with a legal obligation
right to restriction of processing – you have the right to “block” or prevent further use of your personal data while we assess a request for rectification or as an alternative to erasure. Where processing is restricted, we may continue to retain your personal data but may not use it further.
right to data portability – you have the right to obtain and reuse certain personal data for your own purposes across different organisations (which act as separate data controllers). This applies only to personal data that you have provided to us, which we process on the basis of your consent or for the purpose of fulfilling a contract, and which is processed by automated means. In such cases, we will provide you with a copy of your data in a structured, commonly used and machine-readable format or (where technically feasible) can transfer your data directly to another data controller.
right to object – you have the right to object, at any time and on grounds relating to your particular situation, to certain types of processing, insofar as such processing is carried out for the purposes of the legitimate interests pursued by Voyageurs du Monde. We may continue to process your personal data if we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or where processing is necessary for the establishment, exercise or defence of legal claims. Where you object to the processing of your personal data for direct marketing purposes, we will no longer process your personal data for such purposes.
right to withdraw consent – when we process your personal data on the basis of your consent, you have the right to withdraw your consent at any time. However, such withdrawal does not affect the lawfulness of processing carried out prior to the withdrawal.
right to give instructions regarding your personal data after your death – In France, you have the right to give instructions on the management of your personal data after your death (for example, its retention, erasure or disclosure). You may amend or revoke these instructions at any time.

All requests will be reviewed within the time limits set out by applicable law. Exercising your right of access (or any other right) will not give rise to any fees. However, in some cases, we may refuse to act on a request if it is manifestly unfounded or excessive.

We may need to request specific information from you to help us confirm your identity and ensure your right to access the requested information (or to exercise your other rights). This is an appropriate security measure to ensure that personal data is not disclosed to a person who is not entitled to receive it.

If you are not satisfied with our response to your complaint, or if you believe that the processing of your personal data does not comply with the Applicable Legislation, you may lodge a complaint with the competent data protection authority. The Commission Informatique et Libertés (“CNIL”) is the lead data protection authority for Voyageurs du Monde.

10. THIRD-PARTY SITES

The Site may contain links to other websites operated by third parties. Please note that this Privacy Policy applies solely to personal data collected by Voyageurs du Monde. We are not responsible for the personal data that third parties may collect, store or use on their own websites or apps. We recommend that you carefully read the privacy policy of each website and/or app you visit.

Furthermore, Voyageurs du Monde is not responsible for hyperlinks directing to the Site that may be incorporated into third-party websites and/or apps, even where Voyageurs du Monde has authorised the third-party publisher of said website and/or app to place such a link.
